1. GENERAL PROVISIONS ARTICLE 1DESCRIPTION OF THE ORGANIZATION

     The naming body will be the “Student Council of Aldent University” (SCAL).

    ARTICLE 2

    DEFINITIONS

    For the purposes of this statute:

    1. SCAL is the student council of the University of ALDENT
    2. “ SS” is the Student Senate
    3. “EC” is the Election Commission;
    1. “Student Senator” is the student elected from the student body to represent a branch from each year and SCAL to represent the university.
    1. “Constituency” is the branch of study which is represented in the Senate by a senator each year.
    2. “Quorum” is the presence of 50% + 1 of all members of the representative body. To supplement the “Quorum” operation in case of SS meetings does not count the number of senators in recent years.

     

     ARTICLE 3

    GOALS AND OBJECTIVES OF THE STUDENT COUNSIL OF UNIVERSITY OF ALDENT

     

    Student Council of the University “ALDENT” has as its purpose:

     

    – To address student concerns and act to solve them;

    -To contribute to increased organizational and management skills of the most active groups students;

    -To create structures that serve to inform students and care their performance;

    -To cooperate with the governing bodies of the University with the aim of improving the level of teaching and scientific research;

    -To create strengthen ties between the university students and students of other universities in Albania and around the world;

    -To undertake actions that will help to improve the situation of students;

    -To create auxiliary structures in the development of extracurricular activities for students;

    -To provide facility services for students;

    – To develop cultural and educational level of students;

    -To carry out activities aimed at entertainment in its most varied forms.

     

    ARTICLE 4

    OFFICE OF THE STUDENT COUNCIL OF ALDENT UNIVERSITY

    The office (SCAL) is located on the first floor of the main University building. The office and equipment are administered by the President. The office can also be used by other persons whose permission is given by the President. Any person authorized to use the office (SCAL) and devices placed on, takes individual responsibility for any material damage that they may cause.

     

    ARTICLE 5

    POLITICAL INDEPENDENCE

    “Student Council  of the University of Aldent is not a political body, which prohibits any kind of cooperation with political parties and political organizations. All senators, the General Secretary, responsible of departments, members of the Election Commission, members of the committees set up by the SS and members of the working groups established by the (SCAL structures) are banned to announce political statements on behalf of the Student Council of the University of Aldent or its structures.

     

    ARTICLE 6

    RIGHTS AND DUTIES OF STUDENTS IN RELATION TO SCAL

    Each student, after having filled a written request to the class senator and later the Senator holding it to the advisor, and has received authorization from the head of the department to introduce on the agenda an issue, has the right to express his opinions , to discuss the SS meetings, to account for managing funds, etc.

    -Each student has the right to be informed on the activities of SCAL

    -Also, every student has a duty that in the relation to SCAL they comply strictly with the statute of SCAL.

     

    ARTICLE 7

    STUDENT SENATE – SS

    SS is a collegial body, and highest decision maker of SCAL

    SS members are called Senators and are elected every two years by the student community of ALDENT University Faculties. SS meets biweekly.

    SS Meetings are valid when all senators are notified publicly, regardless of the number of participants in the meeting. SS meetings are chaired by the chairman of SCAL. Unless the statute indicates otherwise, the SS decisions are taken by the majority of votes of the Senators present at the meeting. If the votes are equal, the chairman of SC (UGJ) is considered crucial in making decisions. SS Decisions are taken only when the meeting has a quorum. The decision to dismiss the president deals with the secret voting, with 3/5 of the votes of all Senators. SS decisions enter into force as soon as they are signed and sealed by the President. SS has the following powers:

    1-Select or dismiss the president by secret voting;

    2-Dismiss Senator by secret voting;

    3- Appoints the President;

    4-Creates a temporary or permanent commitee on various issues and determines their function.

    5- Decides on the establishment of relations with student clubs with the aim to cooperation and Mutual Assistance.

    6-Announces the date of commencement of the election campaign within the period specified in the statute;

    7 Announces the general election date within Statutory;

    8-Examines and decides on proposals made by the various bodies and organizations for cooperation and mutual assistance; 16 Approves the internal rules of the functionality of SCUAL

    9 Discusses any extraordinary topics set to the agenda of the meeting and makes decisions about it.

     

    ARTICLE 8

    HEAD OF SCAL

    The President must be the senator of SCAL

    The President has a two year term and exercises his powers until the election and the mandate of the new president.

    The Chair is selected from SS once a year and has the following duties:

     

    1. Directs the activities of SCAL under the statute;
    2. Enters into relationships with organisms, other organizations or institutions following the decision taken by the Student Senate.  
    3. Prepares, calls and directs meetings.
    4. Determines the agenda of the meetings.
    5. Prepares, calls and chairs extraordinary meeting.
    6. Takes care of the interests of SCAL, protects them and represents them in relations to third parties.
    7. Holistically or partially delegates his powers to the Vice / President.  
    8. Signs and seals for the entry of decisions.
    9. Prepares the annual draft program of activities and submits it for approval to the Student Senate;
    10. Takes into consideration the proposals made by various institutions and organizations for cooperation and mutual assistance and submits them.
    11. Coordinates and implements the decisions taken.
    12. Authorizes different persons participating in the meeting of the SS with the right of the word or not, by introducing or not on the agenda.

     

     

    ARTICLE 9

    VICE/PRESIDENT OF KSUAL

    • SCAL has a vice / President.
    • SCAL President is selected from SS.
    • Vice / President of SCUAL has one year mandate and exercises his/her competences until the election and the mandate of the new vice/President.

     

    The competences of the Vice / President are:

    1. Take on wholly or partially the powers of the president with his declaration.
    2. If the President loses his mandate as a senator, or resigns, the Vice / President leads.
    3. In the case of the President’s absence, he/she chairs the meeting of the SS.

     

    ARTICLE 10

    MANDATE

    Mandated Senator is conducted by the Election Commission.

    Mandated President of SCAL is performed by Student Senate.

     

    ARTICLE 11

    ELECTION COMMITTEE

    The Election Committee is established from the election of the Student Senate at least one month before the announcement of the election campaign date.

    The mandate of EC is done by SS and lasts until one month after the completion of the process of general elections and internal of SCAL

    EC members are the chairperson of the committee and four university students, two from each faculty.

    EC members shall be nominated by the General Secretary.

    Four members of the EC are voted one by one from the Student Senate.

    The EC member who is also the chairman of the EC is selected as such by the SS.

    The President of the EC chairs the Senate meeting in which is elected a new SCAL chairman.

    The EC members must be students of the University who are not senators and not candidates to become senators.

    EC meetings are valid when all four members are invited and no less than three members participate (two members + president).

    EC meetings shall be convened and chaired by the president of the EC.

    EC decisions are taken by the majority vote. If the votes are equal the vote of the chairman of the EC is considered crucial in making decisions.

    EC has the following competencies:

    1. To organize partial, external and internal elections for SCAL.
    2. Counts the votes and announces the winners.
    3. Examines complaints of various parties and when it deems it necessary, not later than 48 hours, it takes a decision to redo the election process in part or whole.
    4. Appoints candidates for senator who won the elections, no later than a week from the election.

     

    ARTICLE 12

    VOTING PROCEDURES

    The voting procedures for SCAL are the following:

    1. Open vote;
    2. Secret ballot.

    Open voting is done by hand raised.

    The secret voting is done in cases when stated in the statute and when requested by not less than one third of the voters.

    ARTICLE 13

    ELECTIONS

    General elections for reshaping the Student Senate are made once in two years, elections must be held at the beginning of the academic year.

    General elections must begin no later than the third week of the month concerned.

    General elections must be completed no later than the fourth week of the respective month.

    Voting in constituencies is secret, with transparent ballot boxes.

    The selection of students is based on the right of every student to select and to be elected.

    Date of the electorial vote is given by SS no later than the second week of the respective month.

    The campaign continues until the end of elections.

    The electorial vote continues to take available measures and people, for assisting in the technical organization of elections for the student council.

    The announcement of the election date will be made in the faculty and university.

    The University Chancellor must take measures and provide the basis for the voting.

    Elections are held according to democratic Principals, the guarantee of the right to vote freely and secretly, a transparent process, based on the use of voter lists, transparent ballot boxes, the use of sealed ballot papers, counting of ballot papers and declaration of results in the presence of voters.

    Voting is conducted secretly, with a ballot, in terms of an accurate process.

    Candidates have the right to present their ideas, opinions and attitudes facing the student community, through the use of faculty facilities outside the academic use and the printed and electronic media.

    For this reason, they are encouraged to also organize joint forums with candidates to express their opinion in front of the student community.

    “Every student has the right to vote to elect senators (one student representative for one branch each year) the student council of the University.

    Each student is provided with a ballot standard form for his/her branch and marks just beside the name of a candidate, for every year.

    Each student has the right to run for elected student senator (representative of his year branch) in the student council of the university.

    Student enrollment candidates are conducted at the teaching faculty secretaries until 48 hours before the start of the electoral process.

    The final list of students who run for candidates appears in public areas of the faculties and university.

    Prospective students have the right to use the environments of faculties to carry out their electoral campaigns.

    Ballots sheets must be in different colors for each branch and contain the names of all other candidates of the same branch.

    Based on records of educational groups, there are prepared the voter lists, which include all students of the faculties.

    The voting process of the faculty is organized within the same day, concentrated in a public area of the faculty with a single ballot box.

    KZ should follow the correct way to cast ballots in the ballot box and to count the votes collected (by verifying to be equal to those given) as soon as the end of the voting process.

    Each student must put the signature on the voter list against making available the ballot.

    The voting process begins at the hour designated by the EC and ends when there are no students who want to vote. In any case, the voting process can not be terminated prior to the time set by the EC. Immediately after the closing of the polls, votes are counted. The candidates of the respective branch of the year that have received the majority of votes are appointed as student senators (representatives of their year branch). Everyone has the right to observe the process of counting the votes.

     

    The result of the election is announced publicly at the faculty’s premises immediately after the ballots are counted and signed by the members of the EC. Meeting Minutes are deposited in the secretariats of the faculty, while each of the signers is entitled to receive a copy of the minutes.

    President of the Election Board within one week after the election for student senators collects elected student senators, who with a simple majority choose among them the chairman of the faculty student council and later the President of SCAL.

    Immediately after the election of heads of the faculty and chairman of SCAL, the president of the EC signs the minutes of the elections, which are deposited at the educational secretary of the faculty.

    The President of the student council of the faculty conducts the ongoing student senate meetings.

    The university’s student council elects student representatives in the university’s board of directors, in accordance with the statutes and proper regulations of the tertiary education.

    Heads of the student council of the same university choose among them the President of the University Student Council and student representatives in the university senate, in accordance to the statutes of higher education and relevant regulations.

    The dean of faculty makes available the faculty areas throughout the election period, to accomplish the campaign activities of candidate students, which may contain elements such as posters, meetings at the faculty halls, etc.

    The election process is open and can be monitored on any part of it.

     

    ARTICLE 14

    CANDIDACY FOR PRESIDENT

    Every senator of SCAL has the right to run for president.

     

    ARTICLE 15

    PROPOSAL FOR GENERAL SECRETARY

    Every student of the university has the right to be proposed as a general secretary by the chairman.

     

    ARTICLE 16

    THE IMPEACHMENT OF THE PRESIDENT

    The proposal for the impeachment of the president can be done by:

    1/3 of all university students

    1/3 of all senators,* President can be dismissed only by a decision of 3/5 of all SCAL senators

    The decision to dismiss the President is made after a secret ballot is conducted by senators.

     

    ARTICLE 17

    THE IMPEACHMENT OF VICE PRESIDENT

    The proposal for Vice / President to be impeached can be made by 1/3 of all senators; Vice President may be dismissed only with decision 3/5 of all senators. The decision to impeach the deputy chairman is done after the vote may be made through a secret ballot by the senators.

     

    ARTICLE 18

    THE IMPEACHMENT OF THE GENERAL SECRETARY
    Proposal for dismissal of the general secretary may be made by 1/3 of all senators; President. The General Secretary may be dismissed only by the decision of 3/5 of all the senators. The decision to impeach the General Secretary may be made after a secret ballot is conducted by senators.

    ARTICLE 19

    THE IMPEACHMENT OF THE SENATOR
    The proposal for to impeach the Senator can be done by: 1/5 the students of his constituency; 1/3 of all senators; President. Senator may be dismissed only by the decision 3/5 of all student senators. The decision to dismiss the Senator is taken after the student senators conduct a secret ballot.

    ARTICLE 20

    THE LOSS OF THE MANDATE

    The Senator loses his position when:

    -He performs more than five unexcused absences in the SS meetings.

    -Impeaches

    -yields resignation;

     -Get three remarks by the President for ethics violations during the SS meetings or activities contrary to the statute and the interests of SCAL.

    The general secretary shall forfeit his/her term when:

     -He/she does not implement the decisions of the SS and / or the President.

     -resigns;

    -yields resignation.

     

    ARTICLE 21

    THE METHOD OF CHANGING STATUS

    The proposal of changing the status can be done by:

    University Student Senate with the request of 1/3 members of all students of the University; Change of the statute made only with the votes of 3/5 of all SCAL senators. After approval of amendments to the statute is made, it is sent for approval to the Rector of ALDENT University.
